Description
Facts. On July 15, 1968, a criminal complaint was issued, charging Charles Jackson, Robert Norwood and defendant Joshua Guiden with
burglary in violation of sec. 943.10 (1) (a), Stats., and with operating an automobile without the owner's consent in violation
of sec. 943.23, Stats. On July 26, 1968, all three waived preliminary hearing and were bound over to the circuit court. On
September 17, 1968, all three were arraigned in the circuit court. Jackson and the defendant entered pleas of guilty to the
burglary charge, and not guilty to operating the auto without owner's consent. Norwood entered pleas of not guilty to both
charges, and his trial on such pleas preceded the hearing on the guilty pleas of Jackson and the defendant. On January 22,
1969, the charge against the defendant of operating without consent was dropped on motion of the state. On February 3, 1969,
the court accepted the guilty plea of defendant to the burglary charge and found the defendant guilty. Defendant appeals.
