Action for wrongful death in the district court for Kanabec county by the representatives of the estate of Robert Warning, a minor, who was fatally injured when struck by a truck owned by defendant Kanabec County Co-operative Oil Association and driven by the defendant Joseph Fafrowicz. The case was tried before Alfred P. Stolberg, Judge, and a jury. At the close of the evidence, the court granted the motion of defendants for a directed verdict in their favor, and plaintiffs appealed from an order denying their motion for a new trial.
